NEGLIGENCE OF DUE PROCESS AND ORCHASTRATED PLAN TO BRING ABOUT BRIDGE OF PEACE.

I write on behave of aggrieved members of THE PERFORMING MUSICIANS EMPLOYERS’ ASSOCIATION OF NIGERIA (PMAN) CROSS RIVER STATE CHAPTER and to remind you of a petition against you and your executive members but it is saddening that you went ahead to suspend members whom you suspected to back the petition without following the constitution as RULE 14 number (4) of the THE PERFORMING MUSICIANS EMPLOYERS’ ASSOCIATION OF NIGERIA

(PMAN) CONSTITUTION (1991) STATES 

“ A member shall not be fined, suspended or expelled from the Association except reasonable opportunity has been given to him to be heard in person’.

You were petitioned on the grounds of FINANCIAL MISAPPROPATION, IMPOSITION, NEGLIGENCE, IMPERSONATION, ILLEGALLY ARANGED ELECTION AND TOTAL DISREGARD FOR THE CONSTITUTION OF THE PERFOMING MUSICIANS EMPLOYEESASSOCIATION OF NIGERIA (PMAN) BY OUR CROSS RIVER STATE EXECUTIVE. Among others.

We have see your MOTION ON NOTICE though it is clear that it has not been approved by the Chief Justice of Cross River State as I do not see the possibility of an injunction without response from the respondent(s) or appearance in court. In the said motion, your claim of plans to create a parallel government is laughable, as we cannot forget how you totally ignored four consecutive meetings because members asked for proper account of their funds. This singular act prompted the members to invoke RULE 11 Number (11) 

“The Chapter Executive Committee shall also be dissolved by a vote of no confidence passed by a simple majority of all the members of the Chapter. “ 

and we also have the minutes of the general meeting held on the 25th of January which was signed by your then secretary as proof but the PMAN caretaker National Executive Committee sent another latter on the 10th of February to counter the wish of the people and appointing the same person as Cross River State Chapter Executive Committee Chairman even though the constitution does not give him that power but the question however is why will the same people accused of trying to form a parallel government accept the national order if not to foster unity and tranquility.

However, the grievances increased when the caretaker committee held manifesto on the 27th of June and decided to hold elections before time with a planned election on the 10th of July, which was stopped by the police because of our petition and for possible resolution. But the said executives totally ignored every mediation process proposed by the police, but rather choose to fix elections on the 26th of July 2016.

I wish to notify you that your decision to hold elections on the said date is illegal, null, void and tantamount to causing bridge of peace because:

1. Terms of condition Number (3) of your letter of appointment states;

“This appointment shall be for a period of six (6) months from today after which an election will be conducted to produce a new executive that shall take over the running’s and affairs of the chapter in consonance with provisions of PMAN constitution”

(a) That Paragraph restricts you from conduction any election before 10th of August, as the letter was dated 10th of February 2016.

(b) The statement “After Which and election will be conducted’ simply suggest the dissolution of your office at the right time and creation of an independent body to run election and there by makes the election process by your caretaker committee unacceptable and bias.

(c) The statement “In consonance with the provisions of PMAN constitution” bares you from any unconstitutional act e.g.: Unconstitutional suspension of members.

2. The only thing that allows anyone to Vote or be Voted for in PMAN elections is the Biometric ID Card which is paid directly to the Central Bank of Nigeria through National directive and the decision of the Cross River State Caretaker Committee instructing prospective members to pay same to the state PMAN account is Illegal and fraudulent.

3. The decision of the said committee to take over electoral process illegally, disenfranchising prospective candidates, ignoring constitutional stipulations and reference of their appointment letter is a total bridge.

4. The decision of the caretaker committee to unconstitutionally suspend some members is a deliberate arithmetic attempt to hijack the elections.

5. Your decision to hurriedly hold elections without waiting for approval of your motion on notice in the high court of Cross River State of Nigeria, our pending case via our petition to the Cross River State Police Command, Our case in the Industrial Court and High Court respectively, the proposed mediation meeting between your lawyer [Victor Essien and Co.] and our Lawyer [Ozinko Ozinko and Associates], plus a fact that you have not held any general meeting since your manifesto on the 27th of June 2016 only to come out with a broadcast of election on the 25th of July for a proposed election on the 26th of July. I simply see this move as autocratic, an attempt to ignore the rule of law and undermine everyone involved for personal reasons.

We therefor advice that you should only act within the stipulation of the law or we shall be left with no other option than to unleash all legal organizations against you.
